A Statement of Use is a filing confirming that a trademark from an intent-to-use application is now being used in commerce. It includes a verified declaration, use information, specimens, and government fees.
You may file after the USPTO issues a Notice of Allowance and after the trademark is used in commerce with the relevant goods or services. The use must meet federal trademark requirements.
The initial deadline is six months from the Notice of Allowance issue date. If the trademark is not ready for qualifying use, a timely six-month extension request may be filed instead.
You may request up to five consecutive six-month extensions. A Statement of Use must ultimately be filed within three years of the Notice of Allowance issue date.
The specimen must show the trademark as customers encounter it in connection with the listed goods or services. Suitable evidence may include labels, packaging, sales pages, storefront displays, or service marketing materials.
